The Costa Rican competition authority (Coprocom) is presenting the new guidelines for analysis of relative monopolistic practices. Under Costa Rican law, these practices include agreements and unilateral conduct involving companies operating at different levels of the supply chain; for example, an exclusive distribution agreement between a manufacturer and a distributor. The new guidelines seek to provide guidance on how market power and anticompetitive effects will be assessed for the purposes of determining the illegality of these practices. The new guidelines were published in the official bulletin “La Gaceta” of March 19, 2024, available here (from page 10): https://link.btalegal.com/uip
