Under Costa Rican law, the competition authority (COPROCOM) may conduct market studies to deepen its understanding of market dynamics, detect barriers to competition and make recommendations to public and private sector organizations. In guidelines submitted for public consultation until April 17th, 2023, the COPROCOM offers guidance on the rationale of market studies, how specific markets would be selected for study, and the manner in which these studies would be conducted. Firms may be required to provide information as part of these studies. In addition, market studies may trigger an investigation if evidence of anticompetitive conduct is found, depending on specific circumstances. The proposed COPROCOM guidelines are available here:
