{"id":4215,"date":"2026-07-02T11:51:25","date_gmt":"2026-07-02T17:51:25","guid":{"rendered":"https:\/\/btalegal.com\/?p=4215"},"modified":"2026-07-11T12:03:23","modified_gmt":"2026-07-11T18:03:23","slug":"ley-10946","status":"publish","type":"post","link":"https:\/\/btalegal.com\/es\/ley-10946\/","title":{"rendered":"Ley 10946"},"content":{"rendered":"<p>El 24 de junio, Costa Rica public\u00f3 la Ley N\u00ba 10946, \"Gobernanza de los Servicios Digitales y el Comercio Electr\u00f3nico\", que entrar\u00e1 en vigor en 12 meses.<\/p>\n\n\n\n<p>La nueva legislaci\u00f3n establece una serie de principios y normas que rigen la contrataci\u00f3n electr\u00f3nica, el comercio electr\u00f3nico y la protecci\u00f3n del consumidor en entornos digitales, alineando a Costa Rica m\u00e1s estrechamente con las normas internacionales. Cualquier empresa que ofrezca bienes o servicios a trav\u00e9s de canales digitales puede verse impactada.<\/p>\n\n\n\n<p>En nuestra opini\u00f3n, la ley puede crear ciertos riesgos de conflicto con las normativas existentes y los poderes de las autoridades reguladoras en \u00e1reas como la protecci\u00f3n de datos, las telecomunicaciones y los servicios financieros.<\/p>\n\n\n\n<p>Bas\u00e1ndose en varios elementos de la Ley de Servicios Digitales (DSA) de la Uni\u00f3n Europea de 2022, la ley establece obligaciones para los motores de b\u00fasqueda, plataformas online y otros servicios digitales, especialmente los llamados servicios intermediarios. Est\u00e1 por vers\u00e9 si las plataformas que operan desde fuera de Costa Rica se adaptar\u00e1n a las nuevas reglas. Aunque la ley incluye una definici\u00f3n de \"servicios digitales transfronterizos\", no parece asignarle consecuencias legales espec\u00edficas.<\/p>\n\n\n\n<p>A diferencia de la Ley de Mercados Digitales (DMA) de la Uni\u00f3n Europea de 2022, la nueva ley costarricense no aborda cuestiones de competencia en los mercados digitales.<\/p>\n\n\n\n<p>La aplicaci\u00f3n de la ley corresponder\u00e1 a la Comisi\u00f3n Nacional del Consumidor, adscrita al Ministerio de Econom\u00eda. Un reto clave ser\u00e1 garantizar que la instituci\u00f3n disponga de los recursos y capacidades necesarios.
