Por Ley # 10961 publicada el pasado viernes se introduce una importante reforma a la Ley # 7786, relacionada con la prevenci\u00f3n y sanci\u00f3n de la legitimaci\u00f3n de capitales, el financiamiento al terrorismo y el financiamiento de la proliferaci\u00f3n de armas de destrucci\u00f3n masiva (LC-FT-FPADM).<\/p>\n\n\n\n

A las categor\u00edas ya existentes: <\/p>\n\n\n\n

1)<\/strong> intermediarios financieros y otras entidades reguladas por las cuatro superintendencias del sector financiero (art\u00edculo 14);<\/p>\n\n\n\n

2)<\/strong> \u201cactividades y profesiones no financieras designadas\u201d (APNFDs), que incluyen administradores de fondos de terceros, desarrolladores inmobiliarios, prestamistas, casinos y otros (art\u00edculos 15 y 15 bis),<\/p>\n\n\n\n

se agrega una nueva categor\u00eda con obligaciones de inscripci\u00f3n ante SUGEF y prevenci\u00f3n de LC-FT-FPADM:<\/p>\n\n\n\n

3)<\/strong> proveedores de servicios de activos virtuales (nuevo art\u00edculo 15 quater).<\/p>\n\n\n\n

\u201cActivo virtual\u201d se define como una representaci\u00f3n digital de valor o fondo que se puede comercializar o transferir digitalmente y se puede utilizar para pagos o inversiones.<\/p>\n\n\n\n

\u201cProveedor de servicios de activos virtuales\u201d se define como cualquier persona f\u00edsica o jur\u00eddica que se dedique como negocio al intercambio, transferencia, custodia, dep\u00f3sito, administraci\u00f3n o control de activos virtuales, o que provea ciertos servicios financieros relacionados.<\/p>\n\n\n\n

Quedan expuestas a multas importantes las entidades reguladas que tengan relaciones comerciales con sujetos que realicen actividades de los art\u00edculos 15, 15 bis o 15 quater sin estar inscritos ante SUGEF.<\/p>\n\n\n\n

Esta reforma entra en vigor en tres meses. Muy recomendable estar atentos a los respectivos reglamentos y asesorarse.<\/p>\n\n\n\n
