{"id":3843,"date":"2024-11-19T15:43:00","date_gmt":"2024-11-19T21:43:00","guid":{"rendered":"https:\/\/btalegal.com\/?p=3843"},"modified":"2025-01-04T15:50:56","modified_gmt":"2025-01-04T21:50:56","slug":"5-years","status":"publish","type":"post","link":"https:\/\/btalegal.com\/es\/5-years\/","title":{"rendered":"5 years"},"content":{"rendered":"<p>Este martes 19 de noviembre se cumplieron cinco a\u00f1os de la entrada en vigor de la reforma a la legislaci\u00f3n de competencia de Costa Rica aprobada con el ingreso a la OCDE (Ley 9736). Hay importantes avances, entre ellos la independencia t\u00e9cnica de las autoridades de competencia (Coprocom y Sutel), la consolidaci\u00f3n del procedimiento de control de concentraciones y la emisi\u00f3n de valiosas gu\u00edas orientativas. Por otro lado, subsisten grandes retos, entre ellos la dotaci\u00f3n de presupuesto suficiente a la Coprocom. La percepci\u00f3n de que la ley de competencia a\u00fan es poco efectiva no debe llevar a enga\u00f1o; las autoridades pueden abrir investigaciones hasta cuatro a\u00f1os o m\u00e1s desde que se cometa una falta y las sanciones pueden ser muy importantes.
